Public Notice:  Proposed Regulations, December 2017

NOTICE

The Virginia Marine Resources Commission invites public comment on proposed amendments to regulations, as shown below. By November 27, 2017, the proposed draft regulations may be viewed at the Virginia Marine Resources Commission, 2600 Washington Avenue, Newport News, Virginia.

In accordance with Section 28.2-209 of the Code of Virginia, a public hearing on the proposed amendments to these regulations will be held no earlier than 12:00 noon, on Tuesday, December 12, 2017, at the Virginia Marine Resources Commission, 2600 Washington Avenue, Newport News, Virginia. Public comments on the proposals should be provided to Robert L. O�Reilly, VMRC Fisheries Management Division, 2600 Washington Avenue, 3rd Floor, Newport News, Virginia 23607, by 12:00 p.m., Monday, December 11, 2017.

I. Chapter 4 VAC 20-260-10 et seq., �Pertaining to Designation of Seed Areas and Clean Cull Areas�

On October 24, 2017, the Virginia Marine Resources Commission adopted, under its emergency regulatory authority (Section 28.2-210 of the Code of Virginia), amendments to Chapter 4 VAC 20-260-10 et seq., "Pertaining to Designation of Seed Areas and Clean Cull Areas," that established the basket as the only measure for oyster culling tolerance. The Commission proposes to permanently adopt the emergency amendments and consider other amendments to the chapter necessary to establish the basket as the measure for culling inspections.

The purpose of this amendment is to conserve the oyster resource.

II. Chapter 4 VAC 20-252-10 et seq., �Pertaining to the Taking of Striped Bass�

The Commission proposes to amend Chapter 4 VAC 20-252-10 et seq., "Pertaining to the Taking of Striped Bass," to increase the 2018 Coastal Area Commercial Fishery Striped Bass Quota.

The purpose of this amendment is to comply with the requirements of the interstate fishery management plan for striped bass.

III. Chapter 4 VAC 20-252-10 et seq., �Pertaining to the Taking of Striped Bass�

The Commission proposes to amend Chapter 4 VAC 20-252-10 et seq., "Pertaining to the Taking of Striped Bass," to simplify permitting requirements and improve reporting compliance and accuracy from the charter and private striped bass recreational fisheries.

The purpose of these amendments is to promote efficiency in management of the recreational striped bass fishery.

IV. Chapter 4 VAC 20-950-10 et seq., �Pertaining to Black Sea Bass�

The Commission proposes to amend Chapter 4 VAC 20-950-10 et seq., "Pertaining to Black Sea Bass," to establish a February 2018 recreational black sea bass fishery and associated permitting, monitoring and reporting requirements.

The purpose of the amendment is to comply with the Interstate Fishery Management Plan for this species.
