VIRGINIA MARINE RESOURCES COMMISSION
"PERTAINING TO ENLARGEMENT OF RESTRICTED AREA - 
DOMINION POWER/NUCLEAR POWER STATION"
REGULATION 4 VAC 20-1060-10 ET SEQ

PREAMBLE

This chapter redefines restricted areas at Dominion Power/Surry Nuclear Power Station.

This chapter is promulgated pursuant to authority contained in 28.2-201 and 28.2-106.2 of the Code of Virginia.  This chapter amends and re-adopts, as amended, Chapter 4VAC20-1060-10 Et Seq., which was adopted on June 24, 2003 and made effective on October 29, 2010.  The effective date of this chapter is February 1, 2011.

4 VAC 20-1060-10. PURPOSE:

The purpose of this chapter is to enhance the physical security of the facility and is part of a comprehensive plan to protect the public, environment, and economic interests from sabotage and other subversive acts, accidents, or incidents of a similar nature.   

The adoption of this chapter simply affords the Virginia Marine Police the authority to enforce Virginia law that prohibits entrance into the restricted areas. 

4 VAC 20-1060-10. DEFINITIONS:

A.  Pursuant to 28.2-106.2 of the Code of Virginia, the following restricted areas are established adjacent to the James River, Surry Nuclear Power Plant: 

Area 1.  The waters within an area beginning at latitude 3708'59.4"N, longitude 7640'15.5"W; thence to the following points creating a 500 yard arc: latitude 3708'58.8"N, longitude 7640'06"W; latitude 3709'03.1"N, longitude 7639'59.4"W; latitude 3709'06.9"N, longitude 7639'54.1"W; latitude 3709'12.8"N, longitude 7639'48"W; latitude 3709'18.6"N, longitude 7639'48"W; latitude 3709'25.1"N, longitude 7639'48.3"W; latitude 3709'32.3"N, longitude 7639'50.1"W; latitude 3709'37.2"N, longitude 7639'53.1"W; latitude 3709'40"N, longitude 7639'56.6"W; latitude 3709'43.4"N, longitude 7640'03.4"W; thence to a point on shore at latitude 3709'42.7"N, longitude 7640'27.1"W.

Area 2.  The entire discharge canal from the jetties at the mouth of the discharge canal to the circulating water discharge pipes at the head of the discharge canal and including the entire width of the canal.  The discharge canal is located immediately northwest of the power station along both sides of Hog Island Road.

B.  No vessel or persons shall enter the restricted area without the permission of the Virginia Marine Police.  Law-enforcement vessels, United States military vessels and vessels of the Dominion Power/Surry Nuclear Power Plant are exempt from the provisions of this chapter. 

4 VAC 20-1060-10. PENALTY:

A violation of this chapter is a Class 1 misdemeanor.
