Regulation: Taking of fish in Broad Bay and Linkhorn Bay

"TAKING OF FISH IN BROAD BAY AND LINKHORN BAY"
REGULATION 4 VAC 20-10-10 ET SEQ.

PREAMBLE

This regulation establishes seasons and gear limitations on the taking of fish in Broad Bay and Linkhorn Bay.

This regulation is promulgated pursuant to authority contained in §28.2-201 of the Code of Virginia. This regulation amends and re-adopts previous Regulation 450-01-0001, which was adopted May 25, 1954 and effective June 1, 1954. The effective date of this regulation is August 1, 1995.

4 VAC 20-10-10. Purpose.

The purpose of this chapter is to provide for the conservation of fisheries resources in a manner consistent with balanced uses of the marine resources of Virginia.

4 VAC 20-10-20. Devices and seasons; Broad and Linkhorn Bays.

It shall be unlawful to use a haul seine, gill net, or stationary net of any kind, in the waters of Broad and Linkhorn Bays during the months of December, January, February, March and April of each year.

4 VAC 20-10-30. Penalty.

As set forth in § 28.2-903 of the Code of Virginia, any person violating any provision of this chapter shall be guilty of a Class 3 misdemeanor, and a second or subsequent violation of any provision of this chapter committed by the same person within 12 months of a prior violation is a Class 1 misdemeanor.
