REGULATION: PROHIBITS THE USE OF PATENT TONGS ON PUBLIC OYSTER GROUNDS

VIRGINIA MARINE RESOURCES COMMISSION
"PERTAINING TO THE USE OF PATENT TONGS"
REGULATION 4 VAC 20-410-10 ET SEQ.

PREAMBLE

This regulation prohibits the use of patent tongs on Public oyster grounds within the James River.

This regulation is promulgated pursuant to authority contained in §28.2-201 of the Code of Virginia. This regulation amends and re-adopts previous Regulation 450-01-0054, which was adopted April 4, 1989 and effective April 5, 1989. The effective date of this regulation is July 1, 1995.

4 VAC 20-410-10. Purpose.

The purpose of this chapter is to conserve and protect the public oyster grounds in the James River.

4 VAC 20-410-20. Description of area.

This chapter shall include all of the public oyster grounds in the James River upstream of the James River bridge.

4 VAC 20-410-30. Violations.

It shall be unlawful for any person to use or operate patent tongs in any manner on any public oyster grounds in the James River upstream of the James River bridge.

4 VAC 20-410-50. Penalty.

As set forth in § 28.2-903 of the Code of Virginia, any person violating any provision of this chapter shall be guilty of a Class 3 misdemeanor, and a second or subsequent violation of any provision of this chapter committed by the same person within 12 months of a prior violation is a Class 1 misdemeanor.
