4. FISHERIES MANAGEMENT DIVISION, #97-1807, requests authorization to construct, within a 1,000 foot radius around the Newport News Middle Ground Light, a circular, five (5) foot maximum profile, artificial reef to enhance recreational fishing as well as to provide a 72-acre hard clam broodstock sanctuary site in the Lower James River. 

5. FIRST COMMONWEALTH CABLEVISION, LTD., #96-0773, requests authorization to cross beneath 13,000 linear feet of the Rappahannock River with a submerged fiber optic communication cable between Grey's Point in Middlesex County and Cherry Point in Lancaster County along the western side of the Robert O. Norris Bridge. The project is protested by an adjacent property owner.

6. LAWRENCE G. COHEN, #97-1653. Continuation of the Commission's review of Mr. Cohen's request for authorization to install a private mooring buoy approximately 700 feet channelward of his property near Five Gables Drive at 37o 22' 32" North Latitude, 76o 27' 54" West Longitude on the Ware River in Gloucester County. The project is protested by the adjacent property owners.

7. WILLIAM J. MATHESON, #97-2001, requests authorization to install a private mooring buoy at 37o 22' 38" North Latitude, 76o 27' 58" West Longitude, approximately 150 feet north of the L-head of his existing pier located along the Ware River in Gloucester County. The project is protested by an adjacent property owner.

8. G. VERNON TREVILIAN, JR., ET AL, #97-2003, requests authorization to install 389 liner feet of riprap at their property situated along the York River in King and Queen County. Wetlands permit required.

9. PUBLIC HEARING: Proposed regulation entitled "General Wetlands Permit for Emergency Situations" 4 VAC 20-345-10 et seq.

10. PUBLIC HEARING: Consideration of amendments to Regulation 4 VAC 20-260-10 et. seq. for changing the culling tolerance and expanding the clean cull areas.

11. DISCUSSION: The Proposed 1998 Oyster Replenishment Program. 

12. PUBLIC HEARING: Proposed amendments to Regulation 4VAC 20-880-10 et. seq., "Pertaining to Hard Crab and Peeler Pot License Sales," to establish limits on license sales for 1998. 

13. PUBLIC HEARING: Consideration of establishing a limited fishery for American Shad in Chesapeake Bay and its tributaries and/or establishing a moratorium on American Shad harvest in Virginia's portion of the Territorial Sea.

14. PUBLIC HEARING: Proposed amendments to Regulation 4VAC 20-500-10 et. seq., "Pertaining to the Catching of Eels," to clarify restrictions on the possession of elvers.

15. DISCUSSION: Request for amendments to Regulation 4 VAC 20-620-10 et. seq., "Pertaining to Summer Flounder," Regulation 4 VAC 20-950-10 et. seq., "Pertaining to Black Sea Bass and Regulation 4 VAC 20-960-10 et. seq., "Pertaining to Tautog, to establish possession limits, minimum size limits, and closed fishing seasons for the recreational and commercial fishery for 1998.

16. DISCUSSION: Request for amendments to Regulation 4 VAC 20-380-10 et. seq., "Pertaining to Grey Trout (weakfish)," to establish recreational fishing measures for 1998.

17. DISCUSSION: Consideration of adjustments to conch pot permits for the 1998 fishery. 

18. Approval of 1998 Shad Restoration Program procurement procedures.

19. Approval of Marine Recreational Fisheries Statistics Survey supplementation for 1998.

2A. CARGILL, INC., #98-0100, requests authorization to relocate an existing barge and to install two (2) mooring dolphins, a 100-foot timber walkway and five (5) wooden cluster piles adjacent to their commercial facility situated on Jones Creek, a tributary to the Southern Branch of the Elizabeth River in the City of Chesapeake. Recommend a royalty in the amount of $354.50 for the encroachment over 709 square feet of subaqueous land at a rate of $0.50 per square foot.

2B. BERNARD RHEES, #88-2036, requests authorization to modify his existing permit to relocate one (1) of seven (7) previously authorized 42-foot long floating finger pier, which accommodate 13 community wetslips and a pump-out slip adjacent to his property situated along Knitting Mill Creek in the City of Norfolk.

2C. BBB, L.L.C., #97-2040, requests authorization to dredge approximately 8,889 cubic yards of State-owned subaqueous material to create maximum elevations of minus ten (-10) feet at mean low water in order to support waterfront industrial activities adjacent to their property situated along the Southern Branch of the Elizabeth River in the City of Chesapeake. All dredged material will be transported to an approved upland site for disposal. Recommend a royalty in the amount of $2,666.70 for the dredging of 8,889 cubic yards of subaqueous material at a rate of $0.30 per cubic yard.

2D. YORK COUNTY DEPARTMENT OF ENVIRONMENTAL AND DEVELOPMENT SERVICES, #97-2061, requests authorization to replace one stormwater outfall and install a new stormwater outfall adjacent to property situated along the York River at Yorktown Beach. Construction will include trenching, placing bedding stone in the trench, backfilling of the trench, and installing pile bent support structures and armor stone at the terminus of the outfalls.

2E. FISHERIES MANAGEMENT DIVISION, # 94-0520, requests authorization to sink a 110-foot long by 34-foot wide steel deck barge on the Northern Neck Reef, seven nautical miles east of the Great Wicomico Light, in the Chesapeake Bay.

2F. GLOUCESTER COUNTY DEPARTMENT OF PUBLIC WORKS, #97-1686, requests authorization to modify their previously approved permit to construct a 140-foot long addition to the western end of the public fishing pier located at the Gloucester Point Beach on the York River. Specifically, the modification requests an additional 28 linear feet of pier to be constructed on the eastern end of the pier-head.

3A. ERNEST M. BEVINS, #97-1956, requests after-the-fact authorization to retain a 28-foot long by 13-foot wide partially enclosed boathouse adjacent to his property situated along the Rappahannock River in Essex County. The applicant has agreed to pay a civil charge in the amount of $500.00 in lieu of further enforcement action. Staff recommends triple permit fees.

3B. CHESAPEAKE LEISURE, L.L.C., #97-1847, requests after-the-fact authorization for the construction of 130 linear feet of vinyl bulkhead which was constructed approximately one (1) foot channelward of an existing deteriorated bulkhead and authorization to construct an additional 15 linear feet of vinyl bulkhead at the Fishing Bay Harbor Marina in Middlesex County. The applicant has agreed to pay triple permit fees of $75.00, a triple royalty of $195.00 and a civil charge of $1,000.00 in lieu of further enforcement action.
