Publice Notice: Pertaining to Summer Flounder and Various Regs 2004

The Virginia Marine Resources Commission invites public comment on the proposed regulations listed below.

In accordance with §28.2-209 of the Code of Virginia, a public hearing on the proposed amendments will be held at 12:00 Noon on Tuesday, December 21, 2004 at the Marine Resources Commission, 2600 Washington Avenue, Newport News, Virginia.  Written comments on the proposals should be mailed to Jack Travelstead, VMRC Fisheries Management Division, 2600 Washington Avenue, 3rd Floor, Newport News, Virginia  23607, by 5:00 p.m., Monday, December 20, 2004.  Copies of the proposed amendments may be reviewed at the Commission Monday through Friday, 8:15 a.m. to 5:00 p.m. and may be obtained by calling the Commission at (757) 247-2248.

 I.  REGULATION 4 VAC 20-620-10 ET SEQ., "Pertaining to Summer Flounder"

 The Commission proposes to amend the Regulation, as follows:

1.    Increase the cumulative possession limit for the offshore summer flounder fishery in Quarter I from 7,500 pounds to 12,500 pounds.
2.    Increase the cumulative possession limit for the offshore summer flounder fishery in Quarter II from 2,500 pounds to 5,000 pounds.
3.    Open the Quarter I fishery on the last Monday in January.

II. REGULATION 4 VAC 20-15-10 ET SEQ., "Pertaining to License and  Permit Fees"

Section 28.2-201 authorizes the Marine Resources Commission to establish fees for permits required for delayed or limited entry fisheries, shellfish relaying, scientific collection, and for the administrative transfer of these permits among fishermen.  It further authorizes the Commission to increase fees for tidal fishery licenses and permits that are authorized by Title 28.2 or by regulation.  Any fee increase for such licenses and permits shall be capped at $5 or a percentage equal to the increase in the Consumer Price Index calculated from the time the fee was last set or adjusted, whichever is greater.

The Marine Resources Commission invites public comment on a proposal to establish fees for the permits listed above and to increase all license fees in accordance with the requirements listed above.
